2 Contract Creation

The technical steps required to form a contract between you and us are as follows:

You can place an order for Products on the Site by selecting the Products that you wish to purchase from the Online Catalogue. These are stored in your shopping basket until the end of the check-out process. After you have finished your selection select "confirm order." You will be guided through the process of placing an order by a series of simple instructions on the Site.

We will send to you an order acknowledgement e-mail detailing the Products you have ordered. This is NOT an order acceptance from us; it is merely acknowledging that we have received your order and are considering whether to accept it.

Order acceptance and the entering into of a contract between you and us will take place as soon as we have sent an e-mail to you stating that we have accepted your order. If we notify you that we do not accept your order, or do not reply to your order (which we will always endeavour to do, but cannot guarantee that this will always occur); then there will be no contract between us and you to sell you the products that you ordered.

If your item is not in stock, we will back order for you. You will be sent an email with the option to cancel your order if you wish to. In reply to this email you must confirm whether you wish to proceed with your order or whether you wish to cancel your order. If you do not reply, we will not process your order. If you wish to proceed with your order and you inform us of this, we will endeavour to order the product for you, but we will still need to send you an email accepting your order as stated above prior to there being a contract between us.

3 Definitions
3.1 'Conditions' means the terms and conditions set out in this document.
3.2 'Credit/Debit Cards' means any of the following cards: Mastercard, Eurocard, Visa, Visa Electron, Switch, Solo, JCB and Delta.
3.3 'Customer' means the person who buys or agrees to buy the Products from the Supplier by using the Site.
3.4 'Online Catalogue' means the selection of Products displayed on the Site.
3.5 'Price' means the price for the Product(s).
3.6 'Products' means an item or items which the Customer agrees to buy from the Supplier; and 'Product' shall be construed accordingly.
3.7 'Site' means the website located at www.thehockeystop.co.uk or any URL which may replace it and/or also any URL which maps (i.e. sends a user) to the same website.
3.8 'Supplier' means The Hockey Stop Limited, whose registered office is 183 Downall Green Road, Ashton In Makerfield Wigan Lancashire WN4 0DW (Company number: 4803595).
3.9 'UK Standard Shipping' means Royal Mail or Business Post as appropriate.

4 Agreement to sell you products
4.1 These Conditions shall apply to all contracts for the sale of Products by the Supplier to the Customer, to the exclusion of all other terms and conditions.
4.2 All orders for Products shall be deemed to be an offer by the Customer to purchase Products pursuant to these Conditions and any order placed by a Customer must be placed strictly in accordance with these Conditions.
4.3 Acceptance of delivery of the Products shall be deemed conclusive evidence of the Customer's acceptance of these Conditions.
4.4 Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Supplier. These Conditions shall constitute the entire agreement between the parties hereto and shall supersede the provisions of any previous contract, whether in writing or orally and supersedes all previous agreements and understandings between the parties.
4.5 Any information which a Customer is required to provide when they register as a Customer ('Personal Information') must be true, accurate, current and complete in all respects; and the Customer shall notify the Supplier immediately of any changes to the Personal Information by contacting the Supplier via email at shop@thehockeystop.co.uk, or by telephoning on +44(0)1942 605199. The Customer shall not attempt to impersonate any other person or entity and shall not use a false name or a name that they are not authorised to use.
4.6 The Supplier shall take reasonable care, in so far as it is in its power to do so, to keep the details of a Customer order and payment secure, by using the payment service providers "PROTX" and "PayPal", but in the absence of negligence on the part of the Supplier, the Supplier cannot be held liable for any loss a Customer may suffer should a third party obtain unauthorised access to any data provided by a Customer when accessing or ordering from the Site.
4.7 The Supplier does not have access to credit card details for orders made from the Site. All credit card numbers are encrypted when the order is placed using 128 bit encryption, via PROTX's or PayPal's secure servers.
4.8 All orders made by a Customer using the Site or any other ordering facility acceptable by the Supplier, shall be deemed to be an offer by the Customer for the Supplier to supply the Products, pursuant to these Conditions. For the avoidance of doubt, an acknowledgement of any such order or an acknowledgement of payment shall not constitute a contractual acceptance of such an offer. All offers are subject to formal acceptance by the Supplier at its absolute discretion.

6 Matters beyond the control of the Supplier and liability
6.1 If the Supplier is affected by any circumstances beyond its reasonable control (including, without limitation, national emergency, war, prohibitive governmental regulation, strike, lock?out or other industrial action), it shall notify the Customer of the nature and extent of the circumstances on the Site (but only if the Site is still operational at that time).
6.2 The Supplier shall be deemed not to be in breach of any contract between the parties which is subject to these Conditions, or otherwise be liable to the Customer, for any delay in performance or the non?performance of any of its obligations under a contract between the parties which is subject to these Conditions, to the extent that the delay or non?performance is due to any of the circumstances described in clause 4.1 above, and the time for performance of that obligation shall be extended accordingly.

11 Law and details of contract
11.1 Any contract between the parties which is subject to these Conditions is subject to the law of England and Wales and the English courts shall have exclusive jurisdiction to consider disputes regarding the same. All contracts will be concluded in English only. The details of any specific contract will not be filed by the Supplier. If a Customer does require any information regarding an order placed with the Supplier please write to the Supplier at the following address (and the Supplier will endeavour to assist the Customer, but cannot guarantee to do so):

12 General
12.1 The Supplier may assign any contract which is subject to these Conditions and its rights pursuant to any such contract at any time. Subject to the rights of an assignee, a person who is not a party to any contract which is subject to these Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of any contract which is subject to these Conditions.
12.2 The Supplier will not be liable, in contract, tort (including, without limitation, negligence), for pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with these Conditions for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses, suffered or incurred by that party arising out of or in connection with the provisions of any matter under these Conditions.
12.3 If any part of these Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Conditions.
12.4 No waiver by the Supplier shall be construed as a waiver of any proceeding or succeeding breach of any provision.
12.5 The Customer, in agreeing to accept these Conditions, accepts that they have not relied on any representation, save insofar as the same has expressly been made a term of these Conditions and the Customer agrees that they shall have no remedy in respect of any representation.
12.6 The Supplier's Privacy Policy provides information as to how the Supplier may deal with the Customer's personal information and the Customer hereby agrees to the same. The Privacy Policy appears on the Site.
12.7 In certain circumstances third parties may use a payment method offered by the Supplier (on the Site or otherwise), but there shall be no contract between the Supplier and any customer buying products from the third party and the Supplier shall not be liable to such a customer in any way whatsoever in relation to taking such payments (including cases where payment is not taken for any reason). The Supplier shall only be taking payment as the agent of the third party in this situation.
Making A Purchase 5 Price and payment
5.1 All Prices quoted on the Site are in GB Pounds and the Supplier accepts payment by cheque and by Credit/Debit Cards.
5.2 The Price for the Products shall be the price quoted for the time being on the Site. All Prices on the Site are subject to change at any time and without notice.
5.3 The Prices shown are excluding VAT. VAT will be added to the Price automatically if the shipping destination is within the UK or EU.
5.4 The Prices shown are exclusive of any other duties the Supplier may charge the Customer in relation to the same, if required to do so by law or if the Supplier would otherwise have to pay the same should the Customer fail to do so, in addition to the Price (such additional monies shall be payable within 14 days of a request by the Supplier and paid using the method requested by the Supplier).
5.5 Unless and until the Supplier has received confirmation that the Price has been credited to its account on behalf of the Customer, the Supplier shall not be required to deliver the Products (unless expressly agreed otherwise with the Customer).
5.6 The price quoted on the Site for shipping Products is the cost of the Supplier's use of UK Standard Shipping for destinations within the UK. The price quoted for shipping Products to destinations outside the UK is based on the cost of Airmail (for orders weighing up to and including 2kg) or Parcel Force (for orders weighing above 2kg).
5.7 Should the Customer wish to use an alternative to UK Standard Shipping then the Customer should contact the Supplier before placing an order, but the Supplier will have the discretion to accept or reject the proposed delivery method.
Shipping And Handling The price quoted for shipping in our online catalogue is our standard shipping method. By placing an order using our online catalogue, you agree to use our standard shipping method as described below. If you require an alternative shipping method please contact us before you place your order, we will do our best to accommodate your needs.
7 Delivery of the Products
7.1 Delivery of the Products shall be made by the Supplier, or an agent of the Supplier, to such place as the Customer may specify at the time the order is placed.
7.2 In the case of Products purchased using the Credit/Debit Cards method, those Products can only be delivered to the debit card/credit card holder's address and must be signed for on delivery.
7.3 Any applicable delivery charges will be indicated prior to the conclusion of any contract.
7.4 The Customer's order should arrive within 2 working days for destinations within the UK. It may however take up to 10 working days if the Supplier is awaiting stock from one of its suppliers. Time shall not be of the essence when delivering the Products. The Supplier will endeavour to deliver the Products as soon as is reasonably practicable for it to do so.
7.5 If the Products ordered are unobtainable, the Supplier will endeavour to email the Customer to inform them of this.
7.6 The Customer shall make all arrangements to take delivery of the Products whenever they are tendered for delivery by or on behalf of the Supplier. If the Customer is not available to take delivery of the Products when tendered the Customer may be required to pay further delivery charges should the delivery have to be rearranged. Alternative arrangements may be agreed between the Customer and the Supplier, for the collection of the Products by the Customer from a UK address, or a distribution centre in the UK.
7.7 For UK orders: Due to Royal Mail's new rules, as of August 2006 All hockey sticks will sent via Business Post regardless of the shipping method you have selected.
Tax Charges Prices shown are excluding VAT. VAT, which is currently at 17.5%, will be added to your order automatically if the shipping destination is within the UK or EU.

Shipping to destinations outside the UK:
Any additional taxes, import duties or handling charges added to your order when the goods arrive in their destination country are the responsibility of the purchaser.
Credit Card Security All transactions are handled by our PSP's (Payment Service Providers), PROTX and PayPal. The Hockey Stop Limited does not have access to credit card details for orders made through our online catalogue. All credit card numbers are encrypted when the order is placed using 128 bit encryption, via one of our PSP's secure servers and provides the golden padlock symbol, so you can be confident your credit card details are safe.
Guarantee All clothing / equipment are guaranteed against manufacturers defects for a period of 90 days from date of purchase, subject to normal use for the product and a receipt shown with the date of purchase. The parts that are defected will be repaired or replaced at our discretion. Worn items through general use are not covered. All skates are guaranteed against manufacturers defects for a period of 90 days from date of purchase (this does not include wheels and bearings or other wear and tear parts such as sole plates), subject to normal use for the product and a receipt shown with the date of purchase. Sticks, shafts and blades

Due to the nature of the sport, these items are not guaranteed and can last minutes, weeks or months. An unbreakable stick, shaft and blade would not be allowed within the rules of the various sports.

Easton Sports composite / graphite hockey shafts and synergy sticks.

Easton prides itself on the quality and performance of all its products. We have extensive testing and quality control procedures to assure quality and performance. We believe our hockey shafts and our synergy sticks not only meet but also exceed industry quality and durability standards. However, all materials are subject to fatigue and a possible break down over time.

If a consumer has a warranty claim due to a manufacturer's defect on an Easton aluminium or composite graphite hockey shaft and synergy stick, it must be returned to the Easton distributor that sold the product.

Upon returning the product to the dealer or distributor, the conditions for warranty are as follows:

1. The shaft/synergy stick must have been purchased from an "Easton Authorized Dealer or Distributor" in the last 30 days
2. The consumer must have their proof of purchase
3. The shaft/synergy stick must be returned in its entirety. Easton will not warrant a shaft that did not use an Easton replacement blade
4. Excluding manufacturers defect, Easton will not warrant any shaft or synergy stick that has been damaged through normal game action, misuse or abuse. This includes an application of an open flame to the end of the shaft or a skate cut.

Upon making a claim with an Easton dealer, the Easton dealer will contact the Easton distributor for that country. Easton cannot guarantee the warranty of your shaft/synergy stick until it is inspected and determined to be under warranty.

After inspection, if it has been determined that the shaft or synergy stick is covered under warranty, a replacement will be sent to the dealer or the consumer. This warranty is limited to a one-time replacement. If the shaft or synergy stick is determined to be out of warranty, it will not be returned to the dealer or the consumer and will be recycled.

If an Easton distributor no longer has your particular shaft in stock, we will replace the shaft with a model similar in size, weight and performance.

***Warranty reminder: An official, dated computerized cashier's sales receipt, as proof of purchase is required for every product returned to the Easton distributor in that country. Please note, hand written proof of purchase will not be accepted***

Skateboarding Equipment.

Skateboard decks and Trucks are not guaranteed due to the extreme nature of the sport.

Returns Policy 8 Cancellation
8.1 The Customer has a right to cancel a contract between the parties, which is subject to these Conditions, pursuant to the Consumer Protection (Distance Selling) Regulations 2000 (subject to the terms of this Clause 8). Please note that the right to return Products does NOT apply to any Products made to the Customer's specification. The Supplier will notify the Customer as to whether or not a Product will be made to the Customer's specification on the Site, or otherwise. If the Customer is in doubt about this, they should contact the Supplier to discuss.
8.2 The right to cancel must be exercised no longer than seven working days after the day on which the Customer receives the Products.
8.3 The Customer must return the Products to the Supplier at the Customer's expense, following such cancellation, or alternatively, request the Supplier to collect them by or on behalf of the Supplier with the Customer paying the Supplier's costs and expenses (a collection fee may be charged by a distribution agent). The Supplier recommends the Customer to obtain proof of postage, and use a secure delivery method as the Supplier shall not be held responsible for Products lost in transit. Such payments will be recovered from any payment already made by the Customer, or will become payable within 14 days of a request by the Supplier and paid using the method requested by the Supplier.
8.4 All Products returned to the Supplier due to cancellation must be returned to the Supplier in the original packaging. The original packaging must not be damaged. Products that are not returned in the original packaging or with the original packaging damaged are subject to a [40%] re-stocking fee.
8.5 If the Customer wishes to exercise its right to cancel this contract prior to order despatch, the Customer should contact the Supplier on the telephone number provided in the 'About Us' section of the Site.
8.6 Any money paid will be refunded within 30 days provided that the Supplier has received the Products in the same condition they were in at the time of delivery to the Customer. The Customer's account shall then be credited with the amount paid by them to the Supplier. This credit may be used to buy items from the Online Catalogue, or alternatively be exchanged for a refund.

9. Returning Products
9.1 If the Customer is dissatisfied with the purchase due to damage, faults or the item not matching its description, the Customer may within 21 working days of delivery, contact the Supplier via email or telephone to arrange collection of the Products at the Supplier's expense. This does not affect the Customer's statutory rights.
9.2 Any money paid will be refunded within 30 days. The Customer's account shall then be credited with the amount paid by them to the Supplier. This credit may be used to buy items from the Online Catalogue, or alternatively be exchanged for a refund.

10 The Products
10.1 Each Product purchased is sold subject to its description on the Site; which may also include information regarding, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.
10.2 Due to the extreme nature of the sport, hockey sticks, shafts, blades and skateboard decks and trucks are not guaranteed as their useful lifespan cannot be determined.
10.3 Easton Sports composite / graphite hockey sticks and synergy sticks may be subject to the manufacturer's warranty. Should the Customer wish to rely on the manufacturer's warranty the Customer should contact the Supplier.. This does not affect the Customer's statutory rights.
10.4 The Supplier shall take all reasonable care to ensure that all details, descriptions and prices appearing on the Site are correct at the time when the relevant information was entered onto the system. Although the Supplier aims to keep the Site as up-to-date as possible, the information appearing on the Site at a particular time may not always reflect the position exactly at the moment the Customer places an order.
10.5 Although every effort is made to ensure accuracy of Product images these are provided by third parties and for illustrative purposes only.
10.6 To the fullest extent permissible by law, the Supplier disclaims any and all warranties or other terms of any kind, whether express or implied, in relation to the Products. This does not affect the Customer's statutory rights if they are a consumer, nor does it affect any rights of cancellation.
